I have several holiday home clients who are obviously now affected by the 90 day rule (although one client thinks it's a 180 day rule?! :!:

I have heard of instances where Second-home owners in France have been able to obtain a WARP/CdS, but seriously, how? I thought you had to be tax resident to apply, unless it's got so easy now, anyone can get them. I'm reluctant to help, as it's basically lying to the authorities. I don't want to be party to that!

Also, on the 90 day rule - does anyone know how that works? There seems confusion as to whether you can't come back for 90 days, after spending say, a month, here. Or is it just a continuous 90 day, then as soon as you return to your principle residence (getting passport stamped at customs), that's cancelled out, and you could return a couple of days later to start another 90 days?

I believe there is a website which explains it all and offers you a calculator. I have seen reference to it a few times (possibly on here) but I'm sure somebody more knowledgeable than I will be along soon to provide the link.

It is a rolling window of 180 days during which no more than 90 days can be in Schengen.
And that means Schengen. So 90 days in France then 90 in Spain is not acceptable..

What's the score if I,a Brit. living in France with a French CdS, want to overwinter in say Spain ?

As far as I understand your cds is only valid in France and gives you no rights in other countries.
So for Spain you are a UK citizen who is permitted to spend a total of 90 days out of 180 in a foreign country. Your passport should be stamped if you enter Spain to show the entry date.

Do you hold a British or French passport? - guess that is the difference?

The question wouldn't arise if you had a french passport and was moving around schengan

Thanks Sparkle. But I still wonder how non-residents are managing to get Residency Permits.

I was trying to find the article on The Local that was posted some months back re ' long stay visas' but couldn't find it. All I could come up with is this - any use?
