Whilst I accept that no system of justice is perfect, I believe that the French system is an utter mess. Firstly, it needs a sub judice rule so that the media isn’t buggering up the defence and influencing the jury long before the case ever gets to court, a kind of prosecution propaganda (I’ve been both a prosecutor and defender so I know what I’m on about). Remember also that a jury of 12 includes the 3 judges, another obstacle to a fair trial.

French justice always wants to know WHY the perpetrator did what he/she did, which is largely irrelevant.

As for what lawyers do, their function is - or should be - to put forward their client’s case. As Char says, everyone has the right to a fair trial and (Pathca) to the presumption of innocence. That’s in a perfect world. In practice, all sorts of factors come into play, resulting in a kind of legal lottery which benefits no one.

In France, we need more non-custodial sentences for minor crimes and more stringent sentences for major crimes.
