Indeed and that is presumably what happened. Prisons sentences are not given lightly so if the Court decided that the man who took the law into his own hands was guilty, he would have been judged upon the facts.

And that includes showing leniency to the perps as they were of good repute, :angel: :angel: because they might have found prison life uncomfortable, bloody good supposed to be a deterrent although I doubt that would have been the case with these morons, more of a badge of honour when they are released back into society

The facts are he he was charged and imprisoned for what he did ,,appropriately .However uncomfortable that is to people.Had they died he would have been charged appropriately
Having read Hugh’s reply ,judges are bound by sentencing guidelines they cannot make things up because they feel sorry for someone

Tell me you don’t understand the CJS without telling me you don’t understand the CJS
From what I can gather they hadn’t stolen anything,therefore it was an attempt and they were dealt with as such

This supposition that the minute you come into the hands of a nice policeman, you will be dealt with within the parameters of the law, should you be charged is absolute bullshit, firstly the CPS will troll through everything so as to compile a prosecution based merely on the worst scenario, which carries the highest sentence available, therefore handling stolen goods, becomes conspiracy to steal, assault becomes an affray, and so on. We only have to look at the amount of serving police officers, of late, that have been exposed, as being "at it" in one way or another, and it's not just plod, senior, well respected, until exposed, have been caught with their pants down.
Let me tell you a little tale regarding British justice, back in the '70's two of about a dozen men charged, were facing the wrath of that old trout Jean Graham Hall, at Croydon crown court, involving the large-scale theft of telephonic equipment from a British Telecom depot. Let's just say misters A and B, Mr. A was a small-scale dealer in these items, until Mr. B got involved, he was an electrical wholesaler, who created an enormous demand for these items, and a result of such demand increased the thefts out of proportion. No issue here if it is one phone or 100 it is still theft and should be dealt with appropriately.
Both pleaded guilty and were awaiting sentence from the old trout, for what it is worth both defendants had individual barristers due to conflict of interests, so Mr. B comes up first, suddenly his barrister lunges forward to the clerk of the court, with a sealed envelope in his hand, for the sole attention of the judge, who immediately opens it and digests the contents, she then tells Mr. B what a silly man he has been, and gives him a 2-year suspended sentence. Now it is the turn of Mr. A, and in her summing up she makes it abundantly clear he is looking at a custodial, to which Mr. A's barrister jumps up and questions the fact that having given Mr. B a bender, how can she be contemplating a custodial for his client. The answer from that surly old moo was " I might have made a mistake with Mr. B, but I certainly won't with your client". 22 months, take him down.
To my mind that should have been called as a mis-trial needless to say Mr. A was released on appeal of sentencing several months later, British Justice think on.

But they at mid to late 20's, had records going back several years a constant repetition of burglary theft and assault, and as said the gentleman involved didn't know if anything had been stolen at the time. What is he supposed to do having committed himself obviously in a rage, pull up alongside them and say "hey chaps I don't suppose you have anything of mine in your pockets do you", especially when they are toting wrecking bars in their hands, I am not disputing he had committed a crime, but he was also a victim of crime, whatever way he would have had to relocate for fear of a repeat performance.

I suspect that had the fact the garage wasn’t opened and they were two up on a motorcycle was indicative they weren’t carrying anything of value. Anyway I have said my piece I hope I’ve saved you from a boring Wednesday morning
