This case is at the appeal court in Auch, after the original verdict was guilty of murder, Mr Turtle appealed and so here we are today.

basically he appealed the original verdict and has been walking free until this new trial

I suspect he thought that by insisting it was an accident that he would eventually believed. It would seem he nput the justice system's back up by appealing .... and as a result was given a heavier sentence.

I have to say, considering the size of a human body and the diameter of a car wheel, I felt it was an unlikely explanation.

So legal eagles - a question or several.

Does he get out after 20 years and that's it?

Does the case get reviewed after 20 years to see if he is fit to be released and if not he stays inside?

Does he serve half - or some lesser duration - with time off for good behaviour or outside on parole?

[I am asking out of genuine interest - Mrs N is safe!]

I remember this story now - Mr Turtle, former tory councillor, quel surprise! Definitely murder, never believed his story right from the start.

Slightly digressing, speaking of murder, has the definition of this changed? I ask as I always thought murder was premeditated, with intent to kill a particular person. There's been a couple of cases recently where the wrong person got in the line of fire, or run over by a runaway car and it's still being called murder?

Asking for a friend! JOKE! :lol: Mr Bayleaf is also safe! :lol: 8-)

Premeditation is not a prerequisite for murder. Intent to cause harm is however.

Le Code pénal states that mirder is deliberately killing another and attracts a sentence of up to 30 years. AFAIK, he can apply for parole after serving half. It isn't as wide a definition as under English law where having an intention to kill or cause GBH must be proved.
I'm not going to comment on whether the court got it right - I just hope no defence evidence was suppressed and that the trial was fair. (Cf. Omar Raddad).

Tip: try not to get arrested in France.
